Oh wow. This was mentioned in a diesel sweeties comic just recently and I thought they were kidding! When are the big two going to learn that alienating fans is not the way to compete with indie titles?

I can't believe that a trademark like that is actually defendable. I'd put it in the realm of trademarks like "aspirin," "yo-yo," and "frisbee."

IANAL, but I'd bet you're right. However, the big guys have much deeper pockets than the little guy. So even the threat of litigation is potent.
