People will just route it through another device first, strip the flag, and copy the program. Or something. These things never last.

it has to be backwards compadible with old TV and VCRs...which means they have to put it in the signal where it'll be ignored otherwise...so...just get an old system :: shrugs ::

It will, indeed, be part of the signal. But, yes, older equipment will simply ignore the presence of the flag.
