I can hope he'd appoint someone more centrist, but I personally think it's unlikely. Probably we're unluckily in for an overwhelmingly Republican Supreme Court, which I think is unfortunate not only because I'm more liberal than conservative, but also because I believe in checks and balances. And in this system right now there are VERY VERY FEW.

Can he point anyone that partisan with the filibuster techniques?
Even with a Republican majority, many judicial appointments have been blocked due to objections to their political views. Getting anyone with a definite opinion on the court will be a fight.
*sparkle* I love a good tussle.

Bush should appoint Thomas due to his qualifications as well as the positive political attention that would garner.
You want to put the democrats in a tough spot? Make them come up with good reasons to keep Thomas out that aren't going to affect the African American/Black view of things in their own party.
It has been suggested that the Latino population had a little bit of swing towards the Bush camp this election. If he could match that with some movement from the African American/Black side, it would only help in my opinion.
EDIT: Whatever the outcome of nominating Thomas, it would be positive for Bush and negative for the Democrats.
quote:Schumer submitted the following names: • Senator Arlen Specter, Republican from Pennsylvania. • Judge Ann Williams, Seventh Circuit Court of Appeals, nominated by President Reagan to the Northern District of Illinois. • Judge Edward Prado, Fifth Circuit Court of Appeals, nominated by President Bush. • Judge Michael Mukasey, Southern District of New York, nominated by President Reagan. • Judge Stanley Marcus, Eleventh Circuit Court of Appeals, nominated by President Reagan.
I wouldn't be surprised if Judge Easterbrook form the 7th circuit were nominated, but this is no more than a pure guess.

With respect to nominating Thomas as Chief, he wouldn't change the composition of the court, and the Chief has little real power, so Democrats may choose not to fight it.

I have a suspicion that only conservative-leaning justices will choose to retire over the next four years...

I would like to think that those who have led this country wouldn't think about the Supreme Court this way. I hope I'm right.

I think we're going to see Thomas get the chief justice nod and the best Hispanic judge Bush can find will get the first open spot.
